Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of the Sailiently website and application at sailiently.com (the "Service"), provided by Sailiently ("Sailiently", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Sailiently analyses how discoverable and readable web pages are to AI answer engines and produces audits, gap analyses, and suggested rewrites. The Service measures on-page and technical signals and provides informational, advisory guidance only. It does not guarantee that any page will be cited, included, indexed, ranked, or featured by any AI engine or search provider, or any particular traffic or business outcome.

2. Eligibility and accounts

You must be at least 18 and able to form a binding contract to use the Service. You agree to provide accurate registration information, to keep your credentials secure, and to be responsible for all activity under your account. Notify us promptly of any unauthorised use.

3. Credits and billing

The Service uses credits. Actions consume credits at the rates shown in the application (for example, 5 per URL audited, 5 per gap-analysis URL, and 10 per page rewritten). Credits consumed for completed work are non-refundable. Pricing, credit rates, and free allowances may change, and we will reflect changes in the application.

4. Acceptable use

• Only submit URLs and content you own or are authorised to analyse.
• Do not use the Service for any unlawful, infringing, deceptive, or harmful purpose.
• Do not attempt to disrupt, overload, reverse engineer, or gain unauthorised access to the Service or its infrastructure.
• Do not resell or provide the Service to third parties except as expressly permitted.

5. Your content and intellectual property

You retain ownership of the URLs and content you submit and of the page content you provide. You grant us the limited rights needed to operate the Service, including sending content to AI providers to generate your results. The Service, its software, and its design remain our property. Reports and rewrites we generate are provided for your own use in connection with your websites.

6. Stored analysis history

Completed audits and analyses are saved to your account so that you can review them and compare the same page over time. We store the result, its score and factor breakdown, the supporting evidence, the URL analysed, the date, and a record of the scoring configuration in force at that time.

That record exists so comparisons are made on a like-for-like basis. Where our scoring configuration has changed between two analyses, the Service will show both results without presenting a change figure, because the difference would not be attributable to changes in your page.

Stored history is retained for 12 months from the date of each analysis and is then deleted. You can export it at any time. Retention is described further in our Privacy Policy.

7. AI-generated output

Audits, scores, and rewrites are produced by automated analysis and AI models. They may be incomplete or incorrect, and per-engine estimates are directional, not values published by any engine. Rewrites and suggestions are drafts created from your existing content; you must review and verify them — and confirm any claim, statistic, certification, or source — before publishing. You are solely responsible for any content you choose to publish.

8. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that results will achieve any particular outcome.

9. Limitation of liability

To the maximum extent permitted by law, Sailiently will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount paid towards that specific instance of claim, for that specific service only. For example, if you have a proven and accepted claim on a rewrite of one URL, the refundable amount would be $10 (or whatever amount is applicable at that time).

10. Indemnification

You agree to indemnify and hold Sailiently harmless from claims and expenses arising out of your use of the Service, your content, or your breach of these Terms.

11. Suspension and termination

We may suspend or terminate access for any breach of these Terms or to protect the Service or other users. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.

12. Changes

We may modify the Service or these Terms from time to time. Updated Terms take effect when posted here, and your continued use after changes means you accept them.

13. Governing law

These Terms are governed by the laws of India, and disputes will be resolved in the courts of Hyderabad, in the state of Telangana, India, without regard to conflict-of-laws rules.
